Plain English summary: Use CaptureMate lawfully and in good faith. Don't misuse the service, don't capture data without consent, and don't abuse the AI features. We can suspend accounts that violate these terms. Subscriptions are billed in advance and annual plans are locked for 12 months.
1. Who these terms apply to
These Terms of Service ("Terms") govern your use of CaptureMate, operated by T-vest, Norway ("we", "us", "our"). By creating an account or using CaptureMate, you agree to these Terms. If you are using CaptureMate on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
2. The service
CaptureMate is a software-as-a-service (SaaS) application for capturing, managing, and exporting sales leads at live events. Access is provided via app.capturemate.ai.
We reserve the right to modify, suspend, or discontinue any part of the service at any time. We will provide reasonable notice of material changes where possible.
3. Accounts
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. Notify us immediately at privacy@capturemate.ai if you suspect unauthorised access.
Each organisation gets one account. Team members are added via the invite system. You are responsible for all activity that occurs under your account.
4. Acceptable use
You agree to use CaptureMate only for lawful purposes and in accordance with these Terms. You must not:
- Capture personal data without a lawful basis for doing so under applicable data protection law.
- Use CaptureMate to collect data on individuals who have not consented or where collection is otherwise unlawful.
- Attempt to access another organisation's data.
- Reverse engineer, decompile, or attempt to extract the source code of the service.
- Use the AI features to generate harmful, misleading, or illegal content.
- Resell, sublicense, or otherwise commercialise access to CaptureMate without our written permission.
- Use automated tools to scrape, crawl, or extract data from the service.
- Attempt to disrupt, overload, or compromise the security or integrity of the service.
5. Voice notes and AI features
CaptureMate uses AI (Anthropic's Claude) to transcribe voice notes and extract contact information from images. By using these features you acknowledge that:
- Audio recordings are processed to produce text transcriptions and are not retained after processing.
- AI-generated outputs may not be perfectly accurate and should be reviewed before use.
- You are responsible for the accuracy of data exported from CaptureMate to third-party systems.
6. Data and privacy
Your use of CaptureMate is also governed by our Privacy Policy. You retain ownership of all lead data you capture. By using the service, you grant us a limited licence to store and process that data solely for the purpose of providing the service to you.
As the data controller for lead data you capture, you are responsible for compliance with applicable data protection laws including GDPR.
7. Automated follow-up emails (optional feature)
If you enable CaptureMate's automated follow-up feature, we will send a follow-up email to people you capture at an event, on your behalf and on your instructions.
- You are responsible for having a lawful basis to make contact with people you capture, and for complying with applicable marketing, privacy, and electronic communications laws in the jurisdictions where your leads are based.
- You must provide accurate sender identity, company information, and event details for use in these emails.
- You must not use this feature to send unlawful, misleading, or unsolicited bulk marketing.
- We manage the unsubscribe and suppression process on your behalf. You must respect all unsubscribe and suppression records we maintain, and must not attempt to re-contact a suppressed recipient through CaptureMate or otherwise.
- We may suspend this feature for your account if it is misused, generates complaints, or creates a compliance risk.
8. Subscription and billing
CaptureMate is available on a subscription basis. The following billing terms apply:
- Free trial: 14 days, no credit card required. All data is deleted at day 16 if no paid plan is activated.
- Monthly plans: Billed monthly in advance. Cancel at any time — cancellation takes effect at the end of the current billing period.
- Annual plans: Billed for the full year upfront. Annual subscriptions are locked for 12 months — no mid-year downgrade to monthly. Cancellation takes effect at the end of the annual period.
- Upgrades: Take effect immediately. You are charged the prorated difference for the remainder of the billing period.
- Downgrades: Take effect at the end of the current billing period. No refund or proration is applied.
- Failed payments: If a payment fails, we will notify you by email. Access to paid features may be suspended until payment is resolved. Data is retained during a payment failure grace period.
All prices are in USD and exclude applicable taxes. Payments are processed by Stripe.
Plan change rules
The following rules apply to all plan changes:
- Upgrades (moving to a higher tier, or switching from monthly to annual billing) take effect immediately. You will be charged the prorated difference for the remainder of your current billing period.
- Tier downgrades (moving to a lower tier) take effect at the end of your current billing period. You will retain full access to your current plan's features until that date. No refund or proration is applied.
- Billing interval changes (monthly to annual, or annual to monthly) can be made independently of your tier. Switching from annual to monthly takes effect at the end of your current annual period. Switching from monthly to annual takes effect immediately.
- Combined tier and interval changes are not permitted in a single transaction. If you wish to both downgrade your tier and change your billing interval, these must be done as two separate actions — first downgrade your tier (which takes effect at renewal on your current interval), then switch your billing interval separately.
- Annual plans are a 12-month commitment. No refunds or prorated credits are issued for unused months on an annual plan, regardless of whether you downgrade, cancel, or switch to monthly billing mid-year.
9. Data deletion
Upon cancellation or account termination, all organisation data — including leads, events, notes, and team members — is permanently deleted within 2 days of the subscription end date. This deletion is irreversible. Export your data before cancelling if you wish to retain it.
10. Intellectual property
CaptureMate and all associated software, design, and content is owned by T-vest. Nothing in these Terms transfers any intellectual property rights to you. You retain ownership of all data you input into the service.
11. Limitation of liability
To the maximum extent permitted by applicable law, T-vest shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use CaptureMate.
Our total liability to you for any claim arising out of or relating to these Terms or the service shall not exceed the amount you paid us in the 12 months preceding the claim.
12. Warranty disclaimer
CaptureMate is provided "as is" and "as available" without warranty of any kind. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components. We make no warranty regarding the accuracy of AI-generated outputs.
13. Termination
We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or use the service in a way that harms other users or the integrity of the platform. You may terminate your account at any time via the Stripe Customer Portal or by contacting us.
14. Governing law
These Terms are governed by the laws of Norway. Any disputes arising from these Terms or your use of CaptureMate shall be subject to the jurisdiction of the Norwegian courts.
15. Changes to these terms
We may update these Terms from time to time. We will notify active users of material changes via email at least 14 days before they take effect. Continued use of the service after that date constitutes acceptance of the updated Terms.
